Lori Vallow waives extradition to Idaho, bond remains at $5 million

The mother of two missing Rexburg kids appeared in a Kauai courtroom Wednesday afternoon. She could be returned to Idaho as early as next week.

BOISE, Idaho — Lori Vallow, who was arrested in Hawaii over the disappearance of her two Idaho children, has waived her right to an extradition hearing, and will soon be brought back to Idaho to face charges.

Vallow made a court appearance in a Kauai courtroom on Wednesday. She had requested that the judge reconsider her $5 million bail, and lower it to $100,000.

The judge denied that request after a prosecutor argued she is a serious flight risk, and noted her history of ignoring court orders, including violating terms of child visitation rights with one of her ex-husbands in 2011. 

She also ignored a court order in January to show her children to Idaho authorities. Seven-year-old Joshua “J.J.” Vallow and 17-year-old Tylee Ryan have not been seen since September.

Vallow's attorney argued that she is not a flight risk because her passport is expired and because the Idaho authorities filed charges against her after she had already moved to Hawaii.

After lower bail was denied, Vallow's defense team told the judge she wanted to waive her right to an extradition hearing and would voluntarily go back to Idaho to face charges. 

That means Idaho now has jurisdiction over Vallow and she will be extradited as soon as Idaho authorities are able to go to Kauai and bring her back.

Kauai Prosecuting Attorney Justin Kollar said officials in Hawaii are working with the state of Idaho to get that done quickly. Though he couldn't give a definite timeline, he expected the process to take between 7 and 14 days. 

"Given the high profile nature of the case, I don't know what kind of special arrangements need to be made with TSA," he said. "I don't know what kind of protocols have to be followed in a case like this."

A status hearing is set for Wednesday, March 4 to provide updates on the extradition process.

Vallow was arrested on an Idaho warrant last week, and is charged with two felony counts of desertion and nonsupport of dependent children. 

She was also arrested on misdemeanor charges of resisting or obstructing officers, criminal solicitation to commit a crime, and contempt of court.


New court records obtained by KTVB on Wednesday show Madison County has issued four subpoenas in connection to the children's disappearance.

They are addressed to the Madison County School District, Kennedy Elementary School in Rexburg, and the owners of a Kauai beach resort and rental property in which Lori Vallow and her husband Chad Daybell stayed.

The documents include requests for things like Kennedy Elementary discipline records and attendance records, as well as billing and reservation records for the resort.

The subpoenas ask property owners and school officials to appear with the records at a March 9th hearing in Madison County.
