Motion filed to stay execution of Idaho's longest-serving death row inmate

The Idaho Supreme Court will hear oral arguments in early February.

BOISE, Idaho — A motion was filed on behalf of Idaho's longest death row inmate to the Idaho Supreme Court to stay his execution, according to newly filed court documents.

The Motion to Stay Execution of Thomas Creech was filed Wednesday. According to court documents, a date is set for oral arguments on Monday, Feb. 5. Both sides will be given five minutes to present their arguments against or in support of the appeal. 

Attorneys for Creech also filed a brief in support of the stay in his execution.

As previously reported by KREM, a death warrant for Thomas Creech was filed in Ada County District Court on Tuesday, Jan. 30. According to the warrant, the 74-year-old convicted murderer will be executed on Feb. 28, 2024. The warrant did not say how or what time Creech will be executed.

The Idaho Department of Corrections said in a news release last October that they have obtained the chemicals necessary to carry out an execution by lethal injection.

As KTVB previously reported, on Jan. 25, Creech was identified as a suspect in a cold case murder in California from nearly 50 years ago. 

According to the San Bernardino County Sheriff's Department, Daniel Walker was shot multiple times by a suspect who woke him up while sleeping in a parked van alongside Interstate 40 on Oct. 1, 1974. Walker's passenger escaped and was able to get the attention of a passing driver. Walker was eventually taken to an area hospital, where he later died. 

In 1983, Creech pleaded guilty to first-degree murder for killing a fellow inmate in 1981 while he was already in prison. He was sentenced to death.
