An eastern Oregon widow has filed a wrongful death suit against some Oregon institutions.
Jessica Bates claims that despite concerns her husband's accused killer was dangerous, the institutions let him go free.
Police say Anthony Montwheeler intentionally hit an oncoming car after fleeing an Ontario gas station parking lot where he allegedly stabbed his ex-wife to death in January 2017.
Jessica, her husband, David, and their five children were in that oncoming car. David died in the crash.
Montwheeler had been under mental health care for several years when he was released by the Oregon Psychiatric Security Review Board. He was released just a month before the incident.
The suit claims several members of the board expressed concerns that Montwheeler was still dangerous before his release.
Earlier this year, Oregon State Hospital evaluators concluded that Montwheeler was mentally unfit to stand trial.
A judge has since deemed Montwheeler "incapacitated" as a result of a qualifying mental disorder.
An investigation by KTVB's Morgan Boydston in 2017 revealed that Montwheeler put on a decades-long facade, one that records show doctors suspected since the beginning. He admitted to feigning insanity for 20 years at a hearing in front of the Psychiatric Security Review Board on Dec. 7, 2016.
Montwheeler is currently in the custody of the Malheur County Sheriff's Office.
