BOISE, Idaho — A Boise police officer remained behind bars Thursday, a day after he turned himself in on a felony rape charge.
43-year-old Eric Simunich is accused of raping a woman at a home in Eagle last weekend. He made his first appearance in an Ada County courtroom Thursday afternoon.
At the hearing, a prosecutor told the judge that Simunich and the woman went out to dinner on Sunday, and that he later forced himself on her while they were watching a movie at her home.
"At some point he leaned over and she thought he was going to kiss her," deputy prosecutor John Dinger said. "Instead he forcefully flipped her over, pulling down her pants and underwear" before raping her.
Investigating officers said Simunich left the home when the woman told him her ex-husband had texted and was coming over.
The woman called police Monday morning, and underwent a sexual assault exam. Prosecutors say the woman had multiple bruises and a broken finger nail, all evidence of the assault.
A defense attorney said in court on Thursday that the sex had been consensual and that the woman had invited Simunich to her bed.
Simunich remains jailed on $250,000 bond. He has been suspended while the criminal case proceeds and the Boise Police Department conducts an internal investigation.
