New documents show defense's argument for moving University of Idaho murders trial to new venue

Bryan Kohberger's attorney argues that he cannot receive a fair trial and Latah County for multiple reasons.

MOSCOW, Idaho — New court documents have been filed that break down the defense's argument as to why it thinks Bryan Kohberger's trial should be moved out of Latah County.

The defense argues Kohberger's "protection to a fair and impartial jury is infringed without a change of venue," they further argue that a fair and impartial jury cannot be found in Latah County.

The defense argues the "pervasive, inflammatory, often inaccurate and highly prejudicial publicity, and the small size of the jury venire" are reasons Kohberger cannot receive a fair trial in Latah County.

The defense also argues that this trial is an "extreme" case, saying that the atmosphere in Latah County is "utterly corrupted," and therefore requires a change of venue.

The defense also argues that public interest "does not wain" in the case, arguing that the media coverage surrounding the case makes it an extreme case. 

The defense argues that a change of venue is "necessary and appropriate pursuant to Statute and Rule." 

According to the court documents, the defense is asking the court to consider Ada County as the location for the trial. The defense says Ada County is the largest county in Idaho and has ten times as many potential jurors than Latah County.

The defense cites large courtroom space and adequate security in their argument as other reasons to move the trial to Ada County.

Other court documents were released that show the defendant's witness and exhibit list for a motion for a change of venue, which is scheduled for Thursday, August 29.

Kohberger is accused of killing four University of Idaho students, Xana Kernodle, Ethan Chapin, Madison Mogen and Kaylee Goncalves, in November 2022. A trial date has been set for June 2025.

The prosecution is seeking the death penalty if Kohberger is found guilty of the murders.
