BOISE, Idaho — The Office of Police Accountability's (OPA) Director Nicole McKay has released a use of force investigative report on an "critical incident" that took place in January 2023. OPA is separate from Boise Police Department.
A "critical incident" is used by BPD to describe "officer involved incidents that result in serious injury or death as a result of the officer's use of force," Tuesday's news release said.
On January 23, 2023, Boise Police and Idaho Parole and Probation officers were looking to arrest Eli Nash on a felony warrant for evading parole and failing to register as a sex offender.
Officers located Nash sitting in his car in a parking lot near a Texas Roadhouse in Meridian. They ordered him to surrender, and he jumped into the backseat of the car, BPD said. After Cpl. Kip Paporello saw Nash pointing a handgun towards officers, Paporello fired his handgun four times through the back windshield.
Nash died at the scene after life saving measures were performed.
The Blaine County Prosecuting Attorney reviewed the CITF investigation and determined that Paporello's actions were justified under Idaho law. It was determined through this investigation that Nash had a handgun in his possession at the time of the shooting.
According to the report, the handgun that Nash had was a "9 mm CZ handgun with 14 rounds loaded in the magazine and a round in the chamber. The pistol had an exposed hammer, which was cocked and ready to fire."
