Judge rules in favor of city of Eagle in Avimor case

Eagle Mayor Brad Pike confirmed to KTVB the annexation of Avimor into the city of Eagle will move forward.

EAGLE, Idaho — A judge has ruled in the favor of the city of Eagle in the Avimor case. Eagle City Mayor Brad Pike confirmed the ruling with KTVB on Monday, Mar. 18. In the opinion ruling of Judge Jonathan Medema, it states the petition for judicial review was dismissed for lack of standing, further, the petitioners property rights were not impacted by the decision to annex.

"Petitioners argue they are affected persons because they believe their property interests will be adversely affected by the City’s decisions in two ways : higher property taxes and some ill defined reduction in the quality of public services. Neither is sufficient," the judge stated.

The ruling comes after the City of Eagle’s decision to annex Avimor into the city limits went under judicial review. The annexation of Avimor happened in March 2023, when the council approved the annexation 3-1.

Avimor’s annexation made Avimor residents recipients of Eagle city services, which citizens expressed concern about, specifically in regard to land use, water supply, taxes and schools.

The council’s decision resulted in a group called SOS Eagle filing a petition for judicial review. SOS Eagle is a group that formed to “protect the quality of life for Eagle area residents by advocating for transparent, responsive, efficient, and fiscally responsible representation by local government leaders,” according to their website.

A ruling was expected on Mar. 12, but the judge ended up prolonging the decision, which could of been 60 days later, instead Judge Medema brought his decision down about one week later.
