Lawsuit filed over Tamarack cabin fire deaths

Four people died in the gas explosion and fire.

BOISE — A wrongful death lawsuit has been filed by family members of some of the victims of a deadly gas explosion and fire at a cabin near Tamarack Resort last summer.

The fire killed Idaho National Guard Master Sgt. Erin Smith and her daughter Autumn, and National Guard Lt. Col. James Harper the third, and his son "JJ."

The sole survivor was Erin's husband William "Mitch" Smith. The state fire marshal says an uncapped propane line to the cabin's wood-burning fireplace caused the fire. William Smith, Erin R. Smith's estate, and her parents are listed as the plaintiffs in the suit.

The wrongful death suit filed in March also alleges negligence and personal injury. It lists the company that installed the fireplace, the current and former owners of the cabin and several companies associated with Tamarack Resort as defendants.
