BOISE, Idaho — Former Boise City Councilmember Lisa Sánchez has filed an appeal to the Idaho Supreme Court over the loss of her city council seat.
Court records show that an appeal was filed on Oct. 30. As KTVB previously reported, Sánchez filed a lawsuit in April over losing her seat on city council in January. Sánchez claims she inadvertently moved out of her district while the city was being redistricted and was unlawfully removed.
In prior court proceedings, Judge Derrick O’Neil, from a lower court, had canceled her trial with prejudice, stating that although the mistake was probably unintentional, district representatives must live in the districts they represent.
Sánchez had announced in early August via social media that she would not seek re-election because of her new job with U.S. Department of Housing and Urban Development.
Now, it is up to the Idaho Supreme Court whether the case will be seen.
KTVB reached out to her council Wendy Olson. She confirmed the appeal was filed and gave the following statement:
"The district court made its decision as a matter of law. Because this is a novel question of law, and the statutes primarily at issue have not been previously interpreted by the Idaho Supreme Court, we think it is an important question to have answered by Idaho's highest court."
