New Office of Police Accountability releases first 'Use of Force' report on 2022 Fairview Avenue shooting

The OPA was created to investigate and evaluate officer-involved shootings that led to death or injury.

BOISE, Idaho — The Office of Police Accountability (OPA), on Monday, Jan. 8 released its first investigative findings involving the February 2022 incident where a Boise officer shot and injured a 26-year-old man.

In a Use of Force Investigative Report, the OPA justified the Boise Police Cpl. Evans in shooting Jonathan Manee after he pulled a gun on Evans while responding to a stalled car turned crisis call on Fairview Avenue due to several reasons. 

The office said Cpl. Evans was being respectful and calm while trying to move Manee out of the street, even when Manee became agitated. When Manee pulled a loaded gun on the officer, they said it presented an imminent threat to him and the public in the area, so it was "reasonable and necessary to use lethal force."

The report stated a taser or pepper spray would not have been appropriate for the situation. The report continued that Cpl. Evans fired two shots, one hitting Manee on his upper torso and another hitting a passing car and the shot injured nobody.

After Manee was shot, he was no longer a threat and Cpl. Evans controlled his bleeding until medical care could arrive. And Cpl. Evans's actions in the incident didn't break BPD policy or the law. 

The office said there were three reasons why the incident happened. 

"First and foremost is Mr. Manee's threatened use of a firearm against a law enforcement officer. Second is Mr. Manee's unwillingness to cooperate to mitigate the public safety hazards created by both Mr. Manee and his vehicle being in traffic. Third is Mr. Manee's apparent altered thinking and observable irrational behavior," the office said. 

The report also reviewed the findings from the Critical Incident Task Force and BPD's Office of Internal Affairs.

The OPA concluded there would be no recommendations for training or policy, but they will continue tracking data to create better community policing practices.

Back in August of 2022, the Gem County Prosecuting Attorney's Office justified the officer in the shooting.
