Prosecutor justifies BPD officers involved in 2023 North End shootout

The Gem County Prosecuting Attorney Erick Thomson deemed the officers were justified in shooting and killing 28-year-old Macey Juker.

BOISE, Idaho — The Gem State Prosecutor announced the six Boise police officers involved in a 2023 North End shootout that killed 28-year-old Macey Juker were justified in their actions.

On Friday, the Boise Police Department (BPD) issued a news release stating the Gem State Prosecutor Erick Thomson reviewed the body cam footage, and the initial investigation by the Ada County Critical Task Force. After the review he deemed the officers were justified in the shooting.

Thomson released a timeline of the shooting that happened on July 27, 2023, stating that around 10 p.m. Juker called police and was "showing signs of mental illness and stating he had an assault rifle." 

While on the phone police heard gunshots.

When police arrived at N 20th Street in Boise's North End, they found Juker with an assault rifle. The document states Juker was complying with police and put the gun down, but later picked it back up and ran from police. He turned and officers and Juker shot at each other. 

 Juker was shot and fell to the ground but continued to shoot, which prompted officers to shoot him, police stated.

Police initially tweeted at 12:12 a.m. that officers responded to a report of an armed suspect. They later said they were responding to an active shooter.

The Ada County Coroner said Jukers cause of death was multiple gunshot wounds. He was pronounced dead at the scene at 2:18 a.m. Police stated life-saving measures were unsuccessful.

None of the officers were hurt.

The officers involved in the shooting were Sgt. Jason Pietrzak with 27 years of police experience, Sgt. Kirk Rush with nearly 19 years of experience, Chase Fiddler with nearly five years of experience, R. Pollard with over three years of experience, D. Rogers with six years of experience and C. Sousa with nearly four years of experience.
