Idaho murders: Kohberger's attorneys seek to dismiss death penalty

Kohberger's defense team argued that Idaho's right to a speedy trial prevents them from providing effective legal counsel in death penalty cases.

LATAH COUNTY, Idaho — The attorneys for Bryan Kohberger, the man accused of killing the University of Idaho students, are asking for the judge in the case to drop the death penalty.

Kohberger previously waived his right to a speedy trial. However, according to court documents filed in Latah County on Thursday, his attorneys are asking for his right to a speedy trial to be restored. 

In the documents, Kohberger's defense team argued that Idaho's right to a speedy trial prevents them from providing effective legal counsel in death penalty cases. 

Attorneys said Idaho's constitution requires all criminal defendants to be brought to trial within six months of their indictment unless there is good cause for delay. So, Kohberger's attorneys argue that the six-month requirement prevents them from adequately doing their job.

The attorneys also argue a capital case cannot be prepared in ten months.

Kohberger's trial is set to start in June of next year.
