KELLOGG, Idaho — The man accused of murdering four of his neighbors in a Kellogg, Idaho, apartment this summer may not go to trial as originally planned. Instead, the attorneys involved in his case have agreed to try mediation.
Majorjon Kaylor waived his right to a speedy trial on Tuesday, vacating his trial originally set to begin in January 2024. Additionally, Shoshone County Prosecutor Ben Allen and Defense Attorney Christopher Schwartz agreed to participate in mediation before the case goes to trial.
Kaylor, 31, is charged with four counts of first-degree murder and one count of burglary. He is accused of murdering four of his neighbors on June 18, 2023. Since the murders, Kaylor has pleaded not guilty to all charges against him. The state of Idaho previously stated it doesn't intend to seek the death penalty in this case.
According to newly filed documents, Allen and Schwartz must schedule the mediation to occur before Dec. 16. Second District Judge Jay Gaskill will oversee the mediation. Once it's complete, Gaskill will be asked to file a report with the court and let the court know if either party did not cooperate.
All misdemeanor and felony cases are subject to mediation if the court finds it might be beneficial in resolving the case, according to the Idaho State Supreme Court. Issues that may be referred to mediation include the possibility of reduced charges, agreements about sentencing recommendations or possible plea (Rule 11) agreements and the handling of restitution.
Kaylor's trial was set to begin in January 2024. However, because both attorneys in this case have agreed to mediation, that date has been vacated. A new date will not be set until mediation concludes.
